The problem enters in via our pre-engineered assumptions. We should assume that everyone we pass on the street, mall, restaurant, etc. is an object of glowing light...a veritable blank & malleable slate, capable of various transfigurations daily (e.g use the men's room in the morning, the women's room in the afternoon & the sidewalk in the evening --given that squirrel identification would free us from the pesky confines of restrooms in the first place).
To think ANY other way is bigoted, racist and hateful!
(on the other hand, sometimes a 5' 11" white male is a 5' 11" white male)
