Once a POS always a POS...I wouldn't be surprised by it...and I think it would backfire in spectacular fashion...but...brace for it.
Can a Trump-backed Congress undo that? I know SCOTUS is for life - but don't they officially need to be confirmed?
Typically any recess appointment gets replaced with a permanent replacement confirmed by the Senate, but the term of the recess is in doubt given they vary from "recess" appointment (until the next Senate session, in this case January...so pretty pointless to do) or in an inter-session recess (which I guess they are calling this and which can last up to 2 years (the end of the succeeding session).
I have heard nothing from McConnell about what their Senate plans are, but the clown needs to get off his ass and do a pro forma session instead of a recess or intra-session recess...like Reid did to W at the end of his term and like McConnell did in 2012 and SCOTUS ruled 9-0 that pro forma sessions are valid... "the Senate is in session when it says it is" per Breyer...so...
McConnell, declare the Senate open for business!!!
