True enough...but I don't know how the OOD on duty and his crew could lose track of something that large getting that close...all ships track each others position, but a warship should always be in a higher state of awareness, and it increases in intensity at regular intervals as proximity increases.  No excuse on either end, but I expect more from a USN vessel than a commercial tub.

And it is interesting to note 7th Fleet CO Adm Aucoin cited "inadequate leadership" when relieving them...what with another ship under his command suffering another collision resulting in multiple deaths...

...and yeah I am thinking the name McCain might have misfortune attached to it...but then the 7th Fleet CO himself gets axed by CincPac for, get this "loss of confidence in his ability to command"...
