Wisconsin Supreme Court Overturns Judge Sumi


Some key language from the ruling, which overturned Judge Sumi's rulings both procedurally (for interfering in the legislative process) and substantively (there was no violation of the Open Meetings Law)(emphasis mine):
¶6 IT IS FURTHER ORDERED that all orders and judgments of the Dane County Circuit Court in Case No. 2011CV1244 are vacated and declared to be void ab initio. State ex rel. Nader v. Circuit Court for Dane Cnty., No. 2004AP2559-W, unpublished order (Wis. S. Ct. Sept. 30, 2004) (wherein this court vacated the prior orders of the circuit court in the same case).

It's a state law issue, I don't think there is any element to this warranting federal courts getting involved, I think this issue is settled.

Generally, when a higher court calls bullsh*t on a lower one, it's called a remand, a declaration that the lower court got it wrong, and to try again.

Commenters are telling me the court ruled here ab initio, which (context clues, it's been forever since I did anything law-oriented) means it's expunged from memory altogether as being improperly entertained from the start, which means there is no remand to the lower court to try again. The higher court has said "Not only did you get this wrong, you got it so wrong we don't trust you with another bite at the apple, so we're directing your decision from here. It's over. Done. Finished. Kaput."

And more. This judge, Sumi, attempted not to rule a law unconstitutional but a bill -- a not-quite-yet-a-law -- unconstitutional, as she ordered the law to be unpublished, that is, to remain a bill without going to the final step to make it a law.

Sumi did what her masters demanded. Now she looks ridiculous. But she knows it's not about her. It's about the party. Her job was to give rank and file members of the party hope - the illusion of victory - so that when "victory" was taken away, the members would be mobilized into political action. We'll see how that works out.

That is a far cry from the tens of thousands of people who gathered earlier in the year to protest Walker's proposal targeting collective bargaining rights of public employees.


This is the last week of school in Wisconsin then it's time to hit the Dells!  No time for taking off to protest.
