So, another one of Barack Hussein Obama's radical Leftists doesn't make the cut. But how much damage has he done during his interim appointment? How much infrastructure has he put in place? How many lower profile people has he put in places of importance who share his ideology of health care rationing, death panels, and euthanasia?

Sources: Democrats giving up on Donald Berwick nomination for Medicare/Medicaid administrator

Senate Democrats have given up on confirming Don Berwick as CMS administrator in the wake of a letter from 42 Republican senators opposing the nomination, sources tell POLITICO.

Citing the GOP letter, a person familiar with the situation said Senate Democrats and the White House "can do the arithmetic" and now see that there's no way for Berwick to get the 60 votes needed to clear the Senate.

At a meeting with health care lobbyists Friday, Democratic Senate Finance Committee staffers indicated that the nomination is dead, that there will be no confirmation hearing, and that they'll soon be discussing "next steps" for CMS, sources said....

Recess appointment?



I don't know how that works. Berwick is serving a recess appointment now. Presumably he needs to be confirmed, or vacate the position. I don't know if a President can just continuously re-appoint the same person during recess or not. I know that if it is doable on a technicality - even if unethical - I would not put it past Obama to do it. He redefines the parameters of presidential audacity in the service of hubris, and he undermines the office of the president in doing so.

It is a position that congress must approve of.
Obama This poser can make a recess appointment as an emergency but that appointment is only to the end of the year. And then have to hold hearings on appointment to the position.
He has done the damage that Obama the poser sent him to do. ::guillotine::

The obamamessiah will just attempt to make another appointment just as bad as Berwick.  That is they way "community organizers" operate.  I'm sure he can find someone who believes he just as much above the law as the rest of his administration.

Article II Section 2 - The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

It will be vacated upon the end of this current session.  I see no evidence he is prevented from appointing the same person again at the next recess, but typically they don't do that, knowing the Senate will not confirm and to do so again will be poking a stick at congress.  But then again Chairman Obamakov could give a crap less about offending congress, he offends everyone!
