Except it's not really legislation as passed by Congress; it's a regulation by another unelected, unaccountable bureaucracy.

It Is Now a Crime to Unlock Your Smartphone

" ADVISORY

BY DECREE OF THE LIBRARIAN OF CONGRESS

IT SHALL HENCEFORCE BE ORDERED THAT AMERICANS SHALL NOT UNLOCK THEIR OWN SMARTPHONES.

PENALTY: In some situations, first time offenders may be fined up to $500,000, imprisoned for five years, or both. For repeat offenders, the maximum penalty increases to a fine of $1,000,000, imprisonment for up to ten years, or both.*

That's right, starting this weekend it is illegal to unlock new phones to make them available on other carriers.

... Congress passed the Digital Millennium Copyright Act (DMCA) in 1998 to outlaw technologies that bypass copyright protections. This sounds like a great idea, but in practice it has terrible, and widely acknowledged, negative consequences that affect consumers and new innovation. The DMCA leaves it up to the Librarian of Congress (LOC) to issue exemptions from the law, exceptions that were recognized to be necessary given the broad language of the statute that swept a number of ordinary acts and technologies as potential DMCA circumvention violations.

Every three years groups like the American Foundation for the Blind have to lobby Congress to protect an exception for the blind allowing for books to be read aloud. Can you imagine a more ridiculous regulation than one that requires a lobby group for the blind to come to Capitol Hill every three years to explain that the blind still can't read books on their own and therefore need this exception?

Until recently it was illegal to jailbreak your own iPhone, and after Saturday it will be illegal to unlock a new smartphone, thereby allowing it to switch carriers."

The rule disallows one from using another service other than its intended carrier.  I.E.  No more hacking phones for profit.  Did I misread?

My concern:  if we purchase something, do we not own it?  This idea that the company has rights because they still 'own' the hardware/software etc... is a slippery slope.  If they want us to just 'rent' their property, then say so and charge accordingly.  Right?  My mind wanders to how many other things will we just be renting... currently, we 'rent' the equipment that delivers our power, many rent the equipment that delivers the t.v. feed, etc... where is that fine line drawn between what we just use/rent and what we own and have complete control of?

Now?  Nothing.  We own nothing.  You rent your paid-off property from the local government with property taxes, for instance, and, thanks to Obamacare, the care and tending of your own health/illness is on loan, with the applicable permissions from IPAB.

I'm not a techie, so I don't ken the "hack" as stated by pisskop.

I see the similarity to teh recent "Right to repair" referendum here in MA. Car owners and small repair shops were justifiably po'd 'cuz we can't take our car to teh repair shop of our choosing, due to the maker having the diagnostic codes and claiming them as  "intellectual property" or some such crap. I own teh damn car, and I can take it to where ever I want if I can get a better price! That's obviously what it came down to...protecting a monopoly.
Just like with buying a phone. If I want to rent it while purchasing the service, as with cable TV, like Teach said, be honest and commensurate with the price scheme.
I understand there may be tech differences, but what if my PC came with browser software installed and that prevented me from installing another browser...and yes I understand that fight's been fought. I guess that lobbying outfit didn't work as well as the phone co's lobbying outfit.

The impetus behind it is that smartphones are "sold" at a loss to the carrier, whose business model seeks to make up that loss through service charges over the course of a contractual period of usually 2 years. What is BS is saying you can't unlock a phone you bought even after the associated contract has been fulfilled. At that point you theoretically should own the phone free and clear.

A loss at $200-500+ per unit? At those volumes? I believe that's the claim, but do you know this to be the case?

... exactly.  Another example is our vehicles.  We can pay them off, think we own them and still must pay to use them every year... depends on the state I think, but MAN we have to have specific tests done (safety, emissions, etc), tag and license them and pay a yearly personal property tax.  UGH.

and as Dan said, the PC situation has been addressed and fought, however, I think this sort of thing (the phones) just open the door for that to open back up.

I think this goes much deeper, to issues of privacy.  There are so many freakin' laws and regulations to 'save us from ourselves' there are no personal freedoms and individual responsibilities left.

Isn't holding people captive to one provider basically what got Microsoft dragged into court by the Clintonians?  I see nothing different here, since there is no court action by DOJ I can only presume all these providers are donating heavily to the DemonRats, so they can do whatever the hell they want.

And yeah, charging $200-500 for  ::cussing:: phone and they can't make money without locking your ass up for two years?!  BS!  Cut down the campaign contributions and non-stop advertising and you'll make the same amount, but they won't do that...so we all pay through the nose so they can get the political influence they want and fight each other in the ether for entertainment...

And thanks Dan for bringing up the car issue, it always goes back to putting those   ::cussing::  computers in our cars!  They   ::cussing::  your ass with computers!

I get it- the cellular service companies want to be able to offer "free" phones by collecting the cost over the life of the contract. But that is a business model that THEY came up with. Why should the government get involved in protecting the (possibly) poor business decision of these companies? The cellular companies should either charge a fair price for the phone or at the very least call it a "rent to own" program so you own the device at the end of your contract period. Regardless, it worries me that government is passing laws specifically to protect dubious business practices.

It bothers us all here knowing just how morally corrupt the illegal government has become over the last century. The type of government we have now, a mob ruled democracy is perfectly appropriate for the immoral practices of the citizens that put it there. When it finally collapses from it's own weight, there will be such a loud shout of approval from those that have been suffering from it rivaling the shouts of the the Israelites during the Exodus.
