Guessing probably illegal, because it would only strengthen "criminals don't care about gun laws" argument. Had he gotten it legally, it would be all over the news as "gun laws aren't strict enough, this guy got a legal gun".
Have to say it, Capitol police are crappy shots too, letting it go on this long (10+ minutes), having been on the site from the beginning.

So it turns out the shooter used a SKS, not an AK or AR as the media were originally saying. Of course, as far as the MSM are concerned any rifle is an AK-47, sort of like how any handgun is a Glock Saturday Night Special.
