I said "small" because all this does is reassert back to an ability to challenge that should never have been limited or prevented to begin with.  Now, left to the courts to hear individual cases, yeah, might be harder for the State to exert control but not impossible...they have unlimited taxpayer-funded resources to fight with...not every "private" land owner can afford fighting the State to retain control over their own property.
