It's safe to assume that every bit that traverses the Internet is being stored by the Fedcoats. They run filtering algorithms on it in real time, but also store copies for future data mining. With a police state on this scale, it would be impossible to say that "evidence" presented against someone wasn't entirely fabricated and seamlessly integrated into the data dump.
Maybe you could argue that the roots of this spy apparatus go back to legitimate and patriotic motives -- monitoring the Soviets -- but is just further proof that power and authority given to government will always, always end up abused and turned against the citizen. There are no exceptions to this axiom.
