Huh, the accidental looks pretty intentional to me...
Let's switch things up...what if this was a citizen and a cop...the cop was driving like a drunken mad man, lost control of his cruiser and ejected his partner through the window...said partner is dead as a door nail...citizen approaches the still breathing cop and announces he is making a citizens arrest...the cop is trying to get out of the car, the citizen fires a shot and announces the cop is "uncooperative". What do you do?
