Attorney: Glen Burnie shooting was self-defense

A Glen Burnie man acted in self-defense when he shot and killed another man he suspected of having an affair with his wife, his attorney said Monday.
At a bail hearing for Matthew Pinkerton, 34, attorney Peter O’Neill said the victim, Kendall Green, broke into Pinkerton’s home on Arbor Drive just before 2 a.m. Sunday after being told repeatedly to leave.
Green, also of Glen Burnie, acted aggressively and motioned toward his waistband as if he had a weapon, O’Neill said.
Pinkerton shot Green once in the chest from 10 to 15 feet away, but Green continued to advance toward him, his wife Jessica and two friends who were at the house, O’Neill said.
That’s when Pinkerton shot him again. He died at the scene.
“This is clearly self-defense,” O’Neill said.
Pinkerton was charged with second-degree murder, manslaughter and use of a firearm in a felony or violent crime.
The state argued that Pinkerton could have called 911.
District Court Judge Jonas Legum reduced Pinkerton’s bond from $1.5 million to $250,000.
Legum said he finds it “amazing” that the statement of probable cause against Pinkerton is only two pages long, and included only one sentence about whether or not Green had a weapon.
Pinkerton told police he did not see any weapons in Green’s hands, charging documents state.
Green had staked out the Pinkertons’ home before they arrived early Sunday morning, O’Neill said. When Green knocked on the door, Pinkerton retrieved a Glock 17 9mm handgun, put it in his back pocket and went to see who it was, police said. He wasn’t expecting any visitors.
When Pinkerton opened the door, he found Green on the porch, police said. Green demanded to see Jessica Pinkerton.
Matthew Pinkerton told Green to leave, but he refused and started to shout, police said.
The pair exchanged “derogatory” remarks before Pinkerton closed the front door, police said. Green continued to yell from the front porch, police said.
Pinkerton then heard his screen door being opened, police said. He headed back to the front door as Green broke through it, damaging the door frame, O’Neill said.
Pinkerton pulled his gun and ordered Green to leave, O’Neill said.
Green continued into the residence and was shot twice by Pinkerton, police said.
“He has the right to defend himself against an intruder,” O’Neill said.
Assistant State’s Attorney Glen Neubauer said Pinkerton could have called the police. When Pinkerton grabbed his gun, it was “bizarre behavior in itself,” Neubauer said.
But O’Neill said calling 911 wasn’t an option. “By the time 911 is called, he’s dead,” O’Neill said.
Pinkerton, who is in the Air Force, suspected his wife was having an affair last year while he was on a work assignment in Korea, police said.
Pinkerton returned early from his Korea assignment and, upon entering his residence, found Green there with his wife, police said.
Jessica Pinkerton denied the allegations, police said. She would not comment on Monday.
O’Neill described the relationship between Jessica Pinkerton and Green as a “friendship.” When Jessica Pinkerton tried to end the relationship, Green continued to pursue it, O’Neill said.
Green and Matthew Pinkerton had at least one previous altercation, O’Neill said.
So far this year, there have been four homicides in the county and four more in the city of Annapolis.
He should have shot his slutty wife, too. "It takes two to tango."

Yeah he should have definitely ditched his wife back when he first discovered what she was doing. He probably wouldn't be in his current predicament if she was out of the picture.

From friends and family, she was a kind soul looking to help people. She also took in another family who had just recently left because her husband who knew what was going on asked her to ship them out.
This article left out relevant facts such as context about the perp and what has been going on for the last two years. The perp had issues himself. Way more than this article mentioned. I forget where they are on the net but they can be sourced. Open and shut case kept open because of MD's ridiculous new laws on the books. It ahs become a political potato.

Sounds like a winner...if she had left the hubby and joined up with this assclown it is likely she'd be the one in the morgue..she should count her blessings...the hubby ought to say goodbye to bad news.
He should be found not guilty...let me back that up, he should not have been charged, period, but as it is he should be found not guilty but the cost between then and now could be steep...all because fothermucking gun-hating libiot tools want to make it cost!

Heller decision, but that limitations still exist. While the court has been vague on setting boundaries on gun ownership, the state’s lawyers argued that additional firearms placed on the state’s list of banned assault weapons are among the “dangerous and unusual weapons” not considered protected by the Second Amendment.
The Maryland law adds 45 guns to a list of banned assault weapons and limits handgun magazines to 10 rounds.

It's the People's Republic of Maryland, with such luminary representatives as Steny Hoyer and Elijah Cummings, along with Sen. Mikulski. Not to mention that Nanzi Pelousy hails from Baltimore (her father was a mayor of that cesspool: ". . . the youngest of six children of Annunciata M. "Nancy" (née Lombardi) and Thomas D'Alesandro, Jr., who was a Democratic party U.S. Congressman from Maryland and a Mayor of Baltimore; Pelosi's brother, Thomas D'Alesandro III, also a Democrat, was mayor of Baltimore from 1967 to 1971, when he declined to run for a second term"). They are all Owebama butt boys, even the so-called women. No, getting rid of an anti-gun A.G. is not going to happen in Maryland.
There's talk of the more rural western part of the state, the panhandle, seceding very much like the rural Colorado counties wanting to secede from that state, and for the same reason.

Actually, if you guys check out the original Baltimore Sun report it differs very much from what Pinkerton's lawyer is saying. Remember now, guys, blogs are just that : blogs. They're not reputable news sources. They often leave out many things. According to the original report Green was invited inside of the home. There was no mention of forced entry or anything like that. "Green was shot after he was allowed to enter the home, police said. No attorney was listed for Pinkerton in court records."
As soon as Matt got a lawyer the whole situation changed. Which is to be expected.
Just remember : Use critical thinking. O'Neill once got a murderer found not guilty who then committed another murder and is now locked up. Perfect lawyer for Matt Pinkerton.

Let's just say I'm a person very close to the situation. Definitely not a journalist. But I just remember the night I heard "Kendall got shot." (Green) from a close friend. There was no mention of breaking and entering. I think everyone was just wondering why Matt (Pinkerton) did it. Then more than 2 weeks after the incident, Matt's lawyer is claiming Kendall "broke in". In all honesty I believe Matt killed Kendall over the whole affair his wife and Kendall were having. Something snapped in Matt's head that night and he shot'em. This whole "breaking down the door and threatening my family" is a bunch of bologna as far I'm concerned.
Apparently there's neighbors who witnessed Kendall being allowed into the home, as well.
Any ways, I'm just trying to spread the word here. Matt was arrested for a reason, and that's because not everything was cut and dry as Matt is making out to be; actually as Matt's LAWYER is making out to be.
A lot of blogs won't point to the original source of information but will instead go off what the woman, who this whole situation is centered around, has to say.
There's even talk of Kendall (Green) being set-up by the wife of Pinkerton's. There's a lot going on here that I'm guessing will come out in court. Notice how this case isn't getting any national attention either? Probably because the press has seen the police report, which links up directly with what was first reported.
Matt's wife would be the LAST person I believe in this whole case and she's the one who spoke to these bloggers.
NOW, if what Matt's lawyer is claiming happened actually happened then sure I can't argue with Matt shooting him. But again, I can't believe that. The next part is the trial, which will ultimately reveal a lot more.

I know it is not popular now days but there was a time where whacking the guy tapping your wife was not frowned upon...and it would appear nobody on either side of this confrontation is particularly impressed by the woman in the middle of this...maybe the truth will come out in trial, maybe not...the entire system from lazy cops and neat boxes to idiots on juries is tainted...who knows how this thing well end or who is telling the truth? What is clear is the medias bias toward anybody using any kind of gun for any reason whatsoever. Strip that dynamic away, say the guy used a butcher knife, would people be so focused on it?

Okay, so here's a report today from an ACTUAL home invasion. This site also reported on the Pinkerton/Green shooting. I'm trying to find what they originally reported about that but it went nothing like this :

ARMED HOME INVASION GLEN BURNIE
On November 13, 2013, at approximately 7:57 p.m., officers from the Eastern District responded to the 400 block of Darton Court in Glen Burnie for an armed home invasion/ attempted robbery.
Upon their arrival, officers spoke with the 60-year-old female victim, who informed the responding officers that there was a knock front door, the door was answered and two male suspects forced there way into the residence. Both suspects were armed with handguns. Once inside the residence, the suspects demanded money from a resident who was not home at the time. The suspects then fled the scene on foot or in a vehicle without obtaining money or property. The home invasion was reported approximately 45 minutes after it occurred. Victims were not injured during the incident. K-9 and additional patrol units canvassed the area for the suspects, but were unable to locate them. A district detective unit responded to the scene to assist with the investigation. This incident appears to be targeted incident and appears to be drug-related.
