Justice Scalia: ‘It Will Have to Be Decided’ ...

... Whether Gov’t Can Regulate Some Types of Guns

Quote
“What the opinion in Heller said is that it will have to be decided in future cases, what limitations upon the right to keep and bear arms are permissible,“ Scalia said on ”Fox News Sunday,” referring to the 2008 decision in District of Columbia v. Heller that protected the right to possess firearms.

“Some [limitations] undoubtedly are because there were some that were acknowledged at the time,” he continued. “There was a tort called a ”frighting” which if you carried around a really horrible weapon just to scare people, like a head ax or something, that was I believe a misdemeanor. So yes there are some limitations that can be imposed, what they are will depend on what the society understood were reasonable limitations at the time.”

UFB.  How on earth could it possibly be known that any weapon is carried "just to scare people"?!  And so what?  Is there a right to not be frightened?  'Cause Obama and his merry band of thugs violates that "right" every damn day.

And, psssst to Scalia:  "it" has already been decided; see "shall not be infringed".

People, neither the courts nor elections are going to save us.

BTW, I listened this morning to this interview and Scalia spent most of the time mocking Wallace. (Fox News Sunday)

It sounded worse when I heard it than after thinking about it.

Sounds like he was saying you could own that .50BMG but
you couldn't drive around with it mounted in the bed of your
pickup with GS holding the bolt.  And if you did "it was a
misdemeanor".

He said "regulation" is OK.  He specified "states" but we well know the Fed's have bigger designs.

Muskets were the "assault rifles" of the 18th century.  By that logic "assault rifles" of the 21st century are unrestricted, right?

We all know where this is going...

He said the amendment states bear arms therefore cannons are ruled out.
However shoulder fired rockets that can take down an airplane (should be considered).

The real purpose of the 2nd Amendment is to preserve the ability of free citizens to wage war on the State, if that should become necessary. That's the point they are all too afraid to acknowledge.

NRA.   ::)

No doubt they'll look to cut a deal, they are not the pristine gun rights outfit their literature suggests.  Look at what they do, not what they say.

GOA & NAGR are better, they get it.
